This report looks at the raw data and makes some remarks and observations o-n Enforcing School Safety.To be able to do this I have extracted all of the Education-related Enforcement actions and been through HSE sources going back 5-years.

These generally include :

Enforcement Requests

These are orders given by Inspectors to:

Restrict an activity or activity either immediately or with-in a particular time frame,( Prohibition Notice)

Or,

Improve an unsafe action or condition again in just a time frame.( Improvement Notice)

These orders would be the main section of HSEs enforcement activity;for example there were 214 Orders made against schools and employers over-the time frame of the Database,( approx. 5 years) whilst there have been only 34 prosecutions.

Administration Notices are Orders and must be take-n very seriously by anyone who gets one as HSE will prosecute in case a Notice is overlooked.

Ignoring an Enforcement Notice is obviously provided as a criterion for justice in their Enforcement Policy file.

Let us just have a look at what the problem actually is in schools as regards amounts of prosecutions and updates.

Prosecutions

In 2004/5 there were 712 prosecutions altogether made by HSE in-which they secured about 95% success of certainty.

The total number of prosecutions over some time frame for the HSE Database is merely over 4000, which implies that training and schools with 34 prosecutions account for less than hundreds of all prosecutions.

Safety and health at Work Act Sections 2 & 3 are catch-all breaches and primarily Section 2 says not ensuring workers safety and Section 3 not ensuring the safety of others( low employeesi.e students and visitors/contractors).

The greatest amount of notices develop around the Management of Health and Safety at Work Regulations. This can be fairly new and the focus would be to ensure that dutyholders manage safety.This is where there's probably be increasing emphasis for future years.

There's also 26 notices around breaches of the Workplace( H&S) Regulations. This is partly explained by a HSE effort started in Kent to make certain regulation of website traffic and that pedestrians were separated from it.
